The whole concept of estate planning has a couple of primary aims: 1) making sure that your assets are distributed where and how you want them to be, and 2) ensuring that your loved ones are cared for and able to comfortably live out their lives after you are gone. If you consider your pets as part of your property, to whom do you leave them – and the obvious answer is to someone who won’t immediately haul them to the nearest shelter and drop them off.

Providing for your beloved pets may be more complicated than it sounds. There is much to be considered. For example, who will take your dogs and cats in and provide for them with the same loving care you have shown them? Who will develop the same kind of close relationship that your animals are used to sharing with you? Your son may not want a cat that insists on sleeping on his head or your daughter may abhor a dog that sheds all over her chic apartment.

Choosing an appropriate caregiver requires some careful thought and planning. First, you must make certain that whoever is going to care for Bootsie or Fluffy or Shadow, actually likes them and wants to have them around. Sure, a few thousand dollars to provide for Spot’s care over the next 15 years is a huge incentive – big enough to have all kinds of people professing their love and admiration for your friend in fur. While your next door neighbor may genuinely care for Callie the cat and all of her progeny into perpetuity, what happens when the kitty litter budget runs out? If you leave Fergus the dog to your cousin Harold, along with $10,000 to provide Fergus with the best of everything, what’s to guarantee that Harold won’t buy himself the best of everything and let Fergus eat cheap kibbles? What if there is simply nobody to leave Callie or Fergus to because you have no children and don’t trust the neighbors?

Pet care businesses are springing up and advertising their facilities as havens for pets with money. It sounds good in print, but what happens when the facility is full, Sparky is getting old and there is still a few thousand left in Sparky’s care account. If Sparky were to depart a little early, there’d be room for another wealthy resident and Sparky’s assets would revert to the care facility.

That’s precisely why, over the past few years, estate planning for pets has taken a whole new twist. Many people don’t consider their cat or dog as property, but as their best friend, not to be subjected to the twisted machinations of those bent on exploitation. Rather than leaving the pets to someone to be cared for from their assets, some pet owners are choosing to leave the assets to their surviving pets, or at least to make certain the pets are cared for throughout their lifetimes through the mechanism of a trust.

In fact, a trust may be the only way of insuring that your pet receives the love and care to which he or she is entitled after you are gone, particularly if the trust stipulates that any money left over after the pet dies is inherited by a third party rather than the caregiver. The caregiver then has sufficient incentive to keep the pet in question alive and well as long as possible.

Several states already recognize and enforce pet trusts and others will inevitably follow. If your aim is to make certain your pets are not just cared for, but pampered just as you would pamper them, talk to your estate planner about setting up a trust specifically for that purpose.

Innovation Management – The Need For Knowledge Managers

Creativity can be defined as problem identification and idea generation whilst innovation can be defined as idea selection, development and commercialisation.

There are other useful definitions in this field, for example, creativity can be defined as consisting of a number of ideas, a number of diverse ideas and a number of novel ideas.

There are distinct processes that enhance problem identification and idea generation and, similarly, distinct processes that enhance idea selection, development and commercialisation. Whilst there is no sure fire route to commercial success, these processes improve the probability that good ideas will be generated and selected and that investment in developing and commercialising those ideas will not be wasted.

The Economist (2003b) states that 3000 bright ideas are needed for 100 worthwhile projects, which in turn will be winnowed down to four development programmes for new products. And four such development programmes are the minimum needed to stand any chance of getting one winner.

From the above it is clear that a large number of good ideas are required before the innovation process can truly begin. Given that the bright ideas themselves would have been chosen from a larger pool of general ideas, the problem becomes one of maximising idea generation before idea selection begins.

A number of techniques can be used to generate vast quantities of ideas rapidly. For example, asking 100 participants to address a problem and generate five ideas an hour, results in 4000 ideas at the end of one working day.

But what do we do with all these ideas?

An idea is valueless unless it is successfully implemented.

From those 4000 ideas, a selection process has to be organised and many people with varied competencies need to be brought into the idea selection process if good decisions are to be made.

And then those ideas have to be pushed through the innovation process.

But the thing with problems is that they are never ending. The first problem solved is only the most pressing, that problem which is foremost in the bottleneck. And bottlenecks have to constantly be attended to.

A Call for a Worldwide Campaign on Water Conservation

If we are to tackle the challenges of future populations on the planet, we will need to insure adequate water supply. Our US population is growing, by one person every nine seconds and with this growth the consumption of fresh water increases. The average person uses 80-100 gallons per day in the US. In Third world countries about 4-8 total gallons of water per day. I have tested this myself, it is possible to do this;

We need to start a World Wide Campaign about the importance of water by teaching kids the facts and making sure they understand the needs for these infrastructures in the future. Too many areas are expanding rapidly in desert regions, without sustainable water resources, where population explosions move into neighborhoods and put in lawns. In these areas 40% of the residential water use is expended outside the home.

These same issues were a major concern of the ancient Indian cultures who lived on these lands before us. Just like other Indian Cultures in Central and South America, the indigenous people of Australian outback, as well as the water ways and canals built by the Greeks, Romans, Egyptians. Worldwide drought issues will be a problem in the next two decades with an estimated 2.5 billion people without proper fresh water supplies. We must launch our world wide campaign now to promote conservation, proper sewage treatment and empowering peoples to secure and build facilities to insure they will not be without water as the climate changes and leaves whole regions of the world without.

Dealing With Multiple Offer Situations

When you are buying a home, there are many things that you will worry about. Should multiple offers be one?

It would be nice to live in a world where we had all the time we wanted to make up our mind about what we want. But that isn’t often the case in real estate. Some properties are highly sought after. You often have to be ready to make an offer as soon as possible.

Are there rules to multiple offers? Buyers don’t want to be told there are multiple offers because they believe that the agent is lying to push up the offer. They assume that the seller is simply trying to push up the price.

However, when buyers aren’t told about multiple offers and lose the contract, they look for someone to file a complaint against or sue.

Whether or not the buyers are told about multiple offers is up to the seller. Regardless, the buyer has to sit and wait for a response on the offer. The buyer has no rights when it comes to other offers. He can’t ask to see them or even demand that he be told about them.

The National Association of Realtors’ Code of Ethics has several Standards of Practice that deal with multiple offers.

The first is that the Realtor should submit offers and counter-offers objectively and as soon as possible. All offers must be submitted until the seller makes a final decision.

“When acting as listing brokers, Realtors shall continue to submit to the seller/landlord has waived this obligation in writing,” says the NAR code.

As far as telling buyers about multiple offers, the NAR instituted the following instructions a few years ago:

“Realtors, in response to inquiries from buyers or cooperating brokers shall, with the sellers’ approval, divulge the existence of offers on the property.”

Pay attention to the “in response to inquiries” and the “sellers’ approval.” Those are the key words.

Sometimes, an offer submission deadline is in place for a property. This usually happens in a seller’s market. Once the offers are submitted, the agent and the seller go over the contracts. Each offer will be presented to the seller, and the seller will hear all offers before making a decision.

The seller can accept or begin making counter-offers on more than one property at a time, but they must set them up in order of preference. They must also make sure they are released from any other offers before finalizing the successful offer. Selling a house twice isn’t a good idea.

When making an offer on a property that has multiple offers, make sure that you listen to your agent for advice. Find out what the buyer is looking for. Ask why they are moving. Do they already have another home lined up? Look for ways that you can sweeten your deal without facing paying a lot more than everyone else.

Multiple offers are a good thing. Buyers often complain that the process isn’t fair. But it really is. It’s not a first come, first serve situation. The seller is looking at what they get from each offer, not the individual.

Teach Your Child to Live for Maximum Potential

At times, everyone feels a little depressed about life, and children are no exception. Just like you, children often experience “the same old grind.” They get up for school, day care, or camp to travel the same road each weekday. Some children even look forward to weekends in the same way their parents do.

How can you put some excitement into life and teach your child to be successful? Sometimes, parents have to be spontaneous and break the routine up a bit for “family time.” Make it a point to eat together and spend quality time doing new things.

Never say negative things about your life or how boring life is for you. Children can really tune into this, and they always copy their parents. They reflect negative thinking and can hold themselves back by worrying about the risk of failure, just like an adult. Instead, teach them about the endless opportunities that arise in every day life.

Life is full of challenges, and your child has to learn to overcome the fear of failure. This is where you come in – by measuring your child’s progress. You should always point toward his, or her, past successes for positive reinforcement.

Remember the story of the “Tortoise and the Hare?” Teach your child that slow and steady always finishes the race. As an adult, you know that finishing anything is a “bench mark” along the road to progress. A child will give up on a challenge, when they are too far out of their “comfort zone.”

Giving up is a last resort. For example: Look down the road at the many challenges your child will face in college, military service, or at work. You want to establish a “track record” of success now.

Even when challenges and problems have your child in a state of fear, you are obligated to encourage your child to move forward and do their “personal best.” Every successful person has had to face their own fear, in order to see the endless daily opportunities that life has to offer.

Teach your child that life is full of excitement – by making the choices of exploring and trying new things, as long as they are reasonably safe activities. The experience of learning is more important than the chance of failure.

The end result will be that your child has positive memories of accomplishment, and the knowledge that he or she can always count on you.
