It’s been said that, in this litigious society we live in, it’s better to be rich and guilty than poor and innocent. Justice, and access to the legal system, seem to be reserved only for the wealthy. So what are the ‘little people’ supposed to do? What about us ‘average Joe’s’? We have legal concerns, too, and because we’re not among the wealthy, one lawsuit could wipe us out financially. Can we protect our relatively meager assets the way the rich do and still afford to eat?

Actually, there are a number of things the average, middle-class American can do to protect what they’ve worked so hard for. Because our homes are usually our largest assets, we’ll start with that. If you have your home mortgaged to the hilt, you’ve actually ‘protected’ it in one way. Yet, if you’re among those who feel most secure by having a paid-for home, you’re more vulnerable than you think. Sounds counter to logic, doesn’t it? Let me explain.

If someone wanted to sue youover an auto accident, for instancethe first thing they or their attorney will do is try to find out if you’re worth suing. How do they do that? The amount of information about you in the public records is enough for anyone to get a pretty fair idea of what you’re worth financially. However, when they see that your home is mortgaged for very nearly what it’s worth (or in some cases even more than it’s worth), yours doesn’t look like a very profitable lawsuit. On the other hand, if no mortgages are recorded in the public record on your home, all that equity looks mighty tempting to the attorney who’s about to take the case. It’s all at risk.

To protect your paid-for, or nearly paid-for, home, probably the wisest thing to do to protect your equity is to mortgage your house so it looks as though you have no equity at all. Now, you don’t have to put a traditional mortgage on your home and start making those big payments you were so happy to get rid of when you paid off the loan. Instead, apply for the largest home equity line of credit (HELOC) you can get. Equity lines of credit offer the lowest interest rates around these days, and some lenders will allow you to apply for 100% of your home’s valueand the best part is that you don’t pay if you don’t use it. Your lender may require you to take out a certain amount of the available total when you go to closing, but there usually is no penalty for paying it all back immediately, while leaving the entire line of credit open for future use.

How does this protect your home? Lines of credit such as this are recorded in the public records as mortgages (there is no notation indicating that it’s a line of credit so it appears the same as a first mortgage would), and the ‘balance’ is simply the maximum available credit you have access to. The balance you have outstanding on the loan (how much of your equity you’re actually using) is not recorded publicly. So, to the person searching the public records, it looks as though you’re mortgaged to the hilt and have no equity to take in a lawsuit. Quite often, they won’t pursue the lawsuit any further because no ambulance-chasing attorney will take a case on contingency that doesn’t look like it will have a big payout. What a HELOC offers in addition to providing some level of protection for your home from lawsuits, is that you now have all that equity at your disposal with the simple act of writing a checkto pay for home improvements, for college, or to tide your family over through a period of unemployment or even disability.

The next step toward protecting your finances is to consider adding an umbrella liability policy onto your homeowner’s insurance policy. Liability insurance is about the cheapest insurance you can buy, in some cases costing less than $20 a month for a million-dollar policy. This policy would kick in after the liability coverage on your home or cars has been exhausted in a judgment against you, allowing the lawsuit to be settled without you having to sell any assets. Ask the agent who handles your home and car insurance, and don’t hesitate to shop around for a terrific ‘package deal’ including your home, cars, and liability umbrella all with one company.

So what if your local drycleaner ruins your favorite suit and won’t pony up for the damage? Would you even consider calling an attorney to see if you have any recourse? Most people won’t call an attorney, even when they need one, because the cost of the attorney is more than what the situation is costing them. And what if you’re involved in, say, a relatively minor car accident, and you get sued by the other driver? Now what do you do? You definitely need an attorney now, but do you know who you would call?

So when I get to be big, I want to be possible. !! This is a popular joke going around.

But seriously how many times have you heard the question, “What do you want to be when you grow up?” As a teenager you tend to hear this question a lot, but you have probably heard it since you were five years old.

For the first few years, the impact of being with someone who may be a teacher or a doctor or an engineer make us say spontaneously whatever we want to be. We just spurt out the reply without knowing what is in store for us.

The teenagers who would be out of school in a few months begin to ponder about this question. They are now mature enough to decide on what they are good at and what they can specialize in. It requires quite a bit of knowledge to become successful in this tough environment. But it should be remembered that a teenager is fairly nave about the real world and so it is easy to make mistakes during that age which can affect negatively for the rest of your life. They should heed to a fair amount of guidance and counselling at this age.

They would opt for their dream careers once they are out of college but how many are lucky enough to find their dream careers? There are some of us who never decide on our dream careers, while others seem to know exactly what they wish to do from a very young age. How do we find out what work will be our cup of tea??

Asking guidance from experienced people, and experimenting in our lives and treading across the hard facts of life – these are the solutions one has to opt for if one has to be successful in pursuing their dream jobs?

Business Practices for Photographers

There must be as many business policies as there are photographers
in business. Through the years I have learned by my mistakes and
by observing other successful photography business. Here are some
policies that have added to the success of my business.

Concerning weddings, require the full payment for the basic package that
the bride and groom order. Extras must be paid at the time of the final
order. The argument that no goods are in the hands of the buyer must be
politely put aside.

If actual proofs are supplied for perusal, one successful photographer I
know actually supplies these proofs (over 300 3×5s) to the bride and groom
free of charge. The theory is (and it works) that more people over a longer period of
time will see the pictures and place more orders. These proofs are too
small to use as gifts or for display and their gratitude for the free gift is
wonderful for word-of-mouth advertising. I suggest that the proofs be
heavily textured to prevent illegal digital scanning.

I believe that a full guarantee of customer satisfaction be a major policy of
the professional photographer. The consumer is entitled to be happy with
their purchase, even though some criterions are subjective and not the fault
of the photographer. No customer should be left with a bad taste in their
mouth when they leave the studio. You will reap the rewards in additional
referrals and increased orders.

Offer as many free retakes of sessions that have gone wrong for one reason
or another. I know that this policy represents additional costs to the studio
but the clients have no fault when the two year old won’t sit or grandmother
gets sick. Some clients might try to take advantage of this policy by trying
to get free sessions for individuals in a group picture, but the rules must be
stated clearly and posted in the studio for the customers to see.

Some photographers expand the price list lower and higher, quoting higher
and lower levels of quality. I know that the reason is to present more choices
in cost to the customer, but the down side is that the cheaper products will
not represent your best work and the customer may feel cheated. All your
work must be of the finest quality you can produce. Lower prices can only
reflect smaller sizes or fewer quantities.

Promise a realistic date for the work to be completed and make sure that the
work is ready on time. A variable date for completion only serves to undermine
the customer’s faith in your efficiency and good work habits. Reminder calls
are a good idea if the work is not picked up within a reasonable time period.

Assuage the customer’s important concerns and fears early on in your relationship.
Some clients are reluctant to bring up their fears and end up not booking if those
concerns are not addressed.

Never offer any extra pictures you have at no charge to the customer. For some
reason, this never works in favor of the photographer. Be meticulous in preparing
the exact sizes and amounts of their order. On the other hand, you may include a small
(non photographic) gift for their continued support of your services.

Generally, your prices should be commensurate with your major competition, using your
expertise and talent as the reason your customers are satisfied and return for more business.
Bi-annual reappraisal of your price list should be a regular habit. Everything goes up and
you should be no different. Photographers are a dime a dozen but good, successful
photographers are rare.

Even so, you still need to ask yourself: what are the advantages and disadvantages? Time to do some homework – the kind of homework that could save you thousands of dollars.

“It’s not about loans; it’s about changing people’s lives for the better,” says Rory Cambra, president of the North San Diego County Chapter of the California Association of Mortgage Bankers and a mortgage banker with Pacific Capital Mortgage.
What is a second mortgage? Quite simply, it’s another mortgage on your home, and like the first, it’s secured against your property or the equity you’ve built up over the years. They can be fixed-rate or adjustable-rate.

So, what’s the difference between a second mortgage and a home equity line of credit?

“A second mortgage is a lump sum. A home equity line of credit is basically an open checkbook,” Cambra says. Lump sum loans are best when you need all the money at once.. A line of credit is best when your cash needs are stretched out over time, like a series of home improvements or college tuition payments.
Equity is the difference between your home’s value and the balance on your mortgage loan. If your home is worth $500,000 and you owe $400,000 on the mortgage, then you have $100,000 of equity.

“Americans have hundreds of billions of dollars in equity, but most don’t understand that the equity in their home is not safe, liquid or growing,” Cambra says. “Everything from market conditions to disasters can significantly affect your home equity. It could literally just go away.” Before you decide to jump in to the second mortgage waters, assess your family’s financial needs and goals; explore the variety of second mortgage products, and understand how each type best serves your financial picture. Then consider the following:

Second Mortgage Advantages (They increase the more homework you do)

Make your equity work for you. It’s a good thing to separate your equity from your mortgage and put it in a safe, liquid and growing environment. “You’re not doing it to conserve your equity; you’re doing it to create wealth. It can even be used to create your retirement nest egg,” Cambra says.
A cash cushion. Cambra tells his customers that the best first use for your second mortgage is creating a cash cushion, suggesting a minimum of $5,000 be put away for emergencies. Why? So you won’t turn to credit cards the next time an unforeseen financial need pops up.

Pay off debt.

A non-brainer: pay off all your high-interest debts, including credit cards.
Serious liquidity. You can create serious liquidity, like socking away one year’s salary in the bank. (We can dream, can’t we?) Pay for your child’s education. That sigh of relief you just uttered is reason enough.

Create wealth.

Consider this: If you use the proceeds from your second mortgage properly, you can – on paper — pay off your house in full. The key words being, “on paper.” Obviously, you don’t want to miss all the financial and tax benefits that go with your mortgage, but according to Cambra, creating wealth on a balance sheet that is equal to the amount you owe is an accountant’s dream.

2nd Mortgage Disadvantages (They decrease as you do more homework)

Dealing with fear and stress. Everyone has trepidations when it comes to property finances. Fear causes some homeowners back away from a second mortgage. But if you educate yourself, and are prudent with the proceeds, you really haven’t increased your risk.

Not protecting your home.

Be realistic about estimating your future income. If for some reason you cannot pay back the second loan, it could be disastrous. Consuming the proceeds of a second mortgage unwisely. Some homeowners use a second mortgage to take a lavish trip, buy that fantastic new car they’ve always wanted or spend it on frivolities. Then they end up going right back to their credit cards. “It’s a fact: we are human, and we are driven by the pleasures of the world – and those are usually depreciating assets,” Cambra says.

Second Mortgage Costs, Fees & Charges.

2nd mortgages have more defaults, so it’s common for lenders to charge more fees up front. Prepare for and budget the costs. You might also have appraisal fees, points, applications costs and other closing costs. Ask your lender – beforehand – for a printed list of fees.

Essentially, material is produced such that molecules are stretched as part of the manufacturing process. When this material is subjected to heat, the elastic memory of the plastic is activated, causing the material to shrink around the product.

This is a traditional division between packaging for transit and packaging for display, whilst the latter has a further division into food and non-food applications.

The key to the application of shrink wrap for transit is cost so that the material and its application provide the lowest cost solution in delivering the product from the manufacturer to the end user.

The conventional definition of a transit wrap involves the use of a sleeve sealer and polyethylene film. An individual or bundled wrap provides the necessary solution of achieving the shipment at the lowest cost.

A typical wrap offers two open sides as a consequence of the use of a sleeve although in certain applications the sleeve may be effectively eliminated by the use of appropriate machinery. Generally, the latter is not a particular requirement.

Polyethylene has the attributes of strength at a certain thickness together with shrink ratios and slip. Accordingly, a user will be able to specify a thickness to provide the necessary pack integrity to the end user and shrink ratios to ensure that the wrap is tight. Slip can be altered to ensure that packs stack appropriately.

There are further benefits of shrink wrap since waste disposal after delivery is relatively insignificant whilst the material has clarity to allow product to be identified. In addition, there are tamper-evidence and moisture-prevention benefits depending on the exact application.

Normal applications involve the collation of products although individual packs are readily benefited from transit wrapping.

The market also offers developments in this area such as coloured and printed films. Polyethylene is not a particularly good medium for product enhancement through printing or pigmentation as it has a naturally soft surface which allows scuffing and dust retention whilst it is also relatively cloudy.

However, polyethylene may frequently offer sufficient optics so that it is acceptable in these applications.

As technology has advanced in this market so have applications crossed over traditional definitions in certain areas.

Consequently, certain transit packs are found using normal display films where the pack and its marketing benefit from the increased investment in a material that offers better optics and machineability.

There are highly specialised display films that are designed to offer the same strength as polyethylene but with far better optics and the marketing benefit is such, in these very specific areas, that the greater film cost can be justified.

Display shrink wrap is traditionally oriented towards non-food point of sale packaging where the principal goal is product enhancement with some limited pack protection through an overall wrap.

The latter is the main distinguishing feature of display packaging, the partial wrap with a sleeve generally found is replaced with a total wrap involving the creation of a two dimensional bag around the product.

Some years ago, the conventional film used for this purpose was PVC – polyvinylchloride with plasticiser; an amorphous crystalline structure.

PVC has largely been replaced by polyolefin shrink film although PVC continues to be offered.

PVC has particular benefits in that it is the easiest of any films to seal and shrink but it suffers from problems on sealing, whilst it also has strength and storage issues.

PVC’s sealing temperature is very close to its degradation temperature at which a number of by-products are created. These include very small quantities of hydrogen chloride gas and carbon deposits on the sealer.

The HCL may be dealt with through ventilation. It is to be stressed that all materials should be used with regard to good manufacturing practice and as a consequence, polyolefin films will also require ventilation in the same way. The by-products of combustion should always be considered in relation to the use of any specific machine operator.

Carbon deposits require regular cleaning whilst the presence of HCL will give rise to a need for regular maintenance of the sealer. As polyolefin’s have no chlorine, this does not arise with their use.

The plasticiser in PVC will harden in cold conditions and soften in hot conditions and this may well cause strength problems in cold weather and equally machineability problems in hot. Again, as polyolefin material has no plasticiser, these are not issues where this film is concerned.

PVC requires storage at normal room temperature failing which it is likely to start to shrink. Polyolefin will tolerate higher storage temperatures.

The overall machineability of PVC still gives this material some market share but, increasingly, polyolefin has dealt with its lower overall machineability whilst offering the benefits noted above so that it is now by some considerable margin, the principal display material.

Display wrapping involves the creation of a two dimensional bag around the product.

This is conventionally performed using an L Sealer with centre folded film. The sealer allows continuous production of wrapped packs that are then processed through a shrink tunnel.

L sealers are found in a variety of forms – manual, semi and fully automatic. A large part of the manual and semi automatic market has been taken by combined seal and shrink machinery. These machines are commonly referred to as chamber machines.

Fully automatic L sealers have found increasing use as their cost and versatility have improved.

The highest output speeds are offered by flow wrappers using side seal or overlap mechanisms. Nevertheless the common feature of a two dimensional bag remains the principal similarity between all these sealers.

Polyolefin films offer a variety of attributes so that a very large range of applications can be made.

In general, these are not found in food applications although once more, definitions continue to be stretched. Polyolefin is quite well used in certain applications notably pizza and egg wrapping as well as produce packaging. However, a more precise definition might be that polyolefin is not used to extend the shelf life of a food product. This applies generally except where shrink barrier film is used although this latter product is particularly specialised.

Normally, other materials than shrink are used to extend shelf life and as a consequence, shrink is found only in certain food applications although volumes can be significant.

Display applications for polyolefin have almost no limits as materials have been engineered to deal with any given requirement.

Soft shrink as well as perforation and printing are standard offers. At a more specialised level, slip and anti-fog treatments are also available.

There are a few notable ranges of polyolefin shrink film that offer better machineability and performance than the majority of the market and these are particularly distinguished by technical differentiation in manufacturing. These lead to irradiated grades which offer enhanced strength and multi-layer complexes that may be tailored to a particular requirement.

Polyolefin manufacture typically uses three or five layer extrusion and this confers performance benefits as a consequence.

It will be noted that the key to market movement is the development of material to address specific requirements, since its application is relatively uncomplicated.

There is no doubt that polyolefin shrink film will continue to develop so that it addresses even more uses than at present.
